Liability Waiver and Release of Claims

1. Acknowledgment of Risks
I hereby acknowledge that I am voluntarily participating in jobs posted on the Lumper platform, which involve strenuous physical labor. I understand that these activities carry inherent risks, including but not limited to: muscle strains, sprains, falls, and injuries from lifting heavy objects. I am aware of potential hazards present in warehouse and loading dock environments, such as moving vehicles (forklifts, trucks), uneven surfaces, and falling objects. I also acknowledge the risks associated with operating equipment and working in various weather conditions.
2. Release of Liability
In consideration for being permitted to use the Lumper platform, I, for myself, my heirs, and my personal representatives, do hereby release, waive, and discharge Lumper (the "Platform"), the truck drivers posting jobs, and the owners of the properties where jobs are performed, from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, while participating in such activity, or while on the premises where the activity is being conducted.
3. Assumption of Risk
I am fully aware of the risks and hazards connected with these activities and I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me as a result of being engaged in such an activity. I certify that I am physically fit to participate and have not been advised to not participate by a qualified medical professional. I certify that I have the necessary training and will use appropriate equipment for all tasks undertaken.
4. Indemnification
I agree to indemnify and hold harmless the Platform, its agents, employees, and representatives, from any and all liabilities or claims made by other individuals or entities as a result of any of my actions during my participation. This includes covering any legal fees and costs incurred in defending such claims.
5. Insurance Acknowledgment
I acknowledge that I am an independent contractor and not an employee of the Lumper platform or any of its users. I understand that the Platform does not provide any health, disability, or workers' compensation insurance for me. I am solely responsible for obtaining and maintaining my own insurance coverage.
6. Terms Agreement
By using the Lumper platform to claim and perform jobs, I signify my understanding of and agreement to the terms of this Liability Waiver and Release of Claims. This waiver shall apply to any and all jobs I perform through the platform. This agreement shall remain in effect and survive the termination of my account on the platform.
