Terms of Service

1. Acceptance of Terms

By accessing or using the Lumper platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Lumper Inc. ("Lumper," "we," "us," or "our").

The Platform provides a marketplace where truck drivers ("Truckers") can connect with independent contractors ("Lumpers") to perform unloading services. Lumper is not a party to the agreements entered into between Truckers and Lumpers and has no control over the conduct of users on the Platform.

2. User Accounts and Registration

To use most features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement and are legally able to enter into a binding contract.

3. Lumper Services and Responsibilities

As a Lumper, you acknowledge that you are an independent contractor and not an employee of Lumper or any Trucker. You are responsible for your own taxes, insurance, and business expenses. You agree to perform services in a professional and workmanlike manner, adhering to all safety standards.

You are responsible for providing your own equipment unless otherwise specified in a job posting. You agree to communicate promptly and professionally with Truckers and to accurately represent your skills and qualifications.

4. Trucker Services and Responsibilities

As a Trucker, you are responsible for creating accurate and detailed job postings, including location, time, payout, and specific requirements. You agree to provide a safe working environment for Lumpers and to make timely payments for completed services as agreed upon through the Platform.

You are solely responsible for evaluating and selecting Lumpers for your jobs. Lumper does not endorse or guarantee the quality of any Lumper's services.

5. Background Checks and Verification

Lumpers may be required to undergo an identity verification process and a background check conducted by a third-party service. By using the Platform as a Lumper, you consent to these checks. Lumper does not guarantee the accuracy or completeness of any background check and is not responsible for any reliance on such information.

The results of a background check may affect your eligibility to use the Platform. Lumper reserves the right to deactivate your account based on the information obtained from these checks, in accordance with applicable law.

6. Payment Terms

Truckers agree to pay the specified amount for each job to the selected Lumper(s) upon satisfactory completion of the services. Payments are facilitated through third-party payment processors (e.g., Zelle, CashApp). Lumper is not a party to these payment transactions and is not liable for any payment disputes.

Lumpers are responsible for providing accurate payout information. Lumper is not responsible for payments sent to an incorrect account due to user error. All fees and payments are non-refundable unless otherwise determined by Lumper in its sole discretion.

7. Liability and Insurance

The Platform is provided "as is" without warranty of any kind. Lumper disclaims all liability for any damages, whether direct, indirect, incidental, or consequential, arising from your use of the Platform or from any interaction between users.

Lumpers are independent contractors and are responsible for maintaining their own liability insurance, including workers' compensation insurance where required by law. Lumper does not provide any insurance coverage for users.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities: using the Platform for any illegal purpose; misrepresenting your identity or qualifications; harassing, threatening, or defrauding other users; interfering with the operation of the Platform; or attempting to circumvent any security features.

9. Termination

We may terminate or suspend your account and access to the Platform at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

10. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of the Platform will be resolved through binding arbitration, rather than in court. You agree to waive your right to a jury trial and to participate in class action lawsuits.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
